1. GENERAL INFORMATION
Axis Management Group Holdings, Inc. along with its subsidiaries and affiliates including Axis Insurance Services, LLC, NJ Axis Insurance Services, LLC, Axis Insurance Services of New Jersey, LLC, NJ Axis Insurance Agency, PLRisk Specialty Insurance Agency LLC (formerly PLRisk Advisors, Inc.), PLRisk Specialty Insurance Agency, LLC and Axis Management Group, LLC. (collectively “AMGH”) provides this Privacy Policy to users of the AMGH website, mobile applications, and digital assets (collectively, our “Services”).
This Privacy Policy describes, among other things, the types of information we collect when you use our Services, how we use it, and any rights you may have concerning your Personal Information.
This Privacy Policy is integrated into our Terms & Conditions of Use (“Terms & Conditions”).
Except as otherwise prescribed by applicable law, in the event of any inconsistency between the English language version and local language version of this Privacy Policy, the English Language version will prevail.
2. CONSENT
To the extent permitted by law, by using the Services and providing us with Personal Information (defined below), you agree to the practices described in this Privacy Policy and the Cookie Notice that may be provided on our Services and to the updates of policies posted here from time to time. If you withdraw consent, you agree that despite withdrawal AMGH may continue to use your Personal Information previously provided to us to the extent that we are legally or contractually obligated to do so and to the extent necessary to enforce any contractual obligations you may have to us. You also understand that by withdrawing consent we may no longer be able to provide you with services previously available with consent.
If you consented to receiving email communication from AMGH, you will continue to do so unless you unsubscribe. You may choose to opt out of or unsubscribe from receiving future marketing email messages from us. Each marketing email sent from us contains a link with instructions on how to remove yourself from our email list.
3. PERSONAL INFORMATION
In this Privacy Policy, when we use the term “Personal Information,” and except where a different definition is noted, we mean personal information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked with you, directly or indirectly, with a particular consumer as defined under the applicable laws and regulations. When we use the term “Sensitive Information,” we mean Personal Information that is collected and analyzed concerning a consumer’s health, sex life, or sexual orientation, and information that describes a customer’s social security, driver’s license, state identification card, or passport number, a financial account in combination with any access code, password, or credentials allowing access to an account, precise geolocation, racial or ethnic origin, religious or philosophical beliefs, or union membership, contents of mail, email, and text messages unless the business is the intended recipient of the communication, and the consumer’s genetic data. Sensitive Information does not include information that is not covered by applicable privacy laws, including Sensitive Information that is publicly available.

2. Personal Information We May Automatically Collect About You
Our Services may automatically collect certain Personal Information. We use this information to help us design our Services to better suit our users’ needs and for other business purposes as described in this Privacy Policy. This Personal Information may include:
- System and Device Information
- We collect information about the computer, tablet, smartphone, or other electronic device you use to connect to our Services.
- Every computer on the Internet has a unique address called an Internet Protocol (“IP” Address). An IP address is just like a telephone number in that it is a long string of numbers. - Information provided by social networks connected to the Service, in accordance with your privacy settings on the social media platform. The connected social network may provide us with information such as your name, ID, profile picture, network, gender, username, user ID, email address, friend list, age or age range, language, country, friends list, follower list, photos, location, generated contact, and any other information you have agreed it can share or that the social network provides to us. It also includes information you provide to us directly through our Services on social media networking and blogging platforms (e.g., Facebook, Instagram, YouTube, and Twitter).

Flash Cookies

- beneficial parties for Information necessary to resolve client disputes or inquiries
- Disclosure of Personal Information for Legal and Administrative Reasons. We may disclose your Personal Information without notice: (i) when required by law or to comply with a court order, subpoena, search warrant, or other legal process; (ii) to cooperate or undertake an internal or external investigation or audit; (iii) to comply with legal, regulatory or administrative requirements of governmental authorities (including, without limitation, requests from the governmental agency authorities to view your Personal Information); (iv) to protect and defend the rights, property or safety of us, our subsidiaries and affiliates and any of their officers, directors, employees, attorneys, agents, contractors and partners, and the website Service users; (v) to enforce or apply our Terms & Conditions; and (vi) to verify the identity of the user of our Services.

8. CHILDREN’S PERSONAL INFORMATION

We will retain your Personal Information for as long as needed to provide you Services. You are also responsible for ensuring the accuracy of the Personal Information you submit to us. Submitting inaccurate Personal Information or failing to maintain the accuracy of Personal Information that changes (for example, a change of email address) may disrupt your ability to use our Services, may affect the information you receive from us, and may impact our ability to contact you. Shine the Light Law
California Civil Code Section 1798.83 also known as the “Shine The Light” law permits California residents to request certain Personal Information and to opt out of the disclosure of your Personal Information by us to third parties for the third parties’ direct marketing purposes. We may offer you certain financial incentives for the collection of your Personal Information and as permitted by law. These incentives may result in different prices, rates, or quality levels. California “Do Not Track” Disclosures

Process to Make Privacy Right Requests (also known as Data Subject Requests)
- Number of Requests. You may only make a verifiable consumer request for access or data portability related to your Personal Information twice within a twelve (12) month period.
- Verifying Requests.
- If you request access to or deletion of your Personal Information, we will take steps and may require you to provide certain Personal Information to verify your identity before granting you access to your Personal Information or complying with your request. In addition, if you ask us to provide you with specific pieces of Personal Information, we will require you to sign a declaration under penalty of perjury that you are the consumer whose Personal Information is the subject of the request. If you designate an authorized agent to make a request on your behalf, we may require you to provide the authorized agent written permission to do so and to verify your own identity directly with us (as described above).
- The verifiable consumer request must provide sufficient Personal Information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative. This means that in making a request you may be required to: provide your email and phone number, customer Personal Information, and/or account sign-up authentication or other information needed to verify your identity depending on the sensitivity of the Personal Information that is the subject of the request.
- We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. If we are unable to verify your identity, we reserve the right to deny the request. Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
- Authorized Agent. You have the right to designate an authorized agent to make any of these requests on your behalf. If you choose to use an authorized agent to submit a request to know or a request to delete your Personal Information, we may require that you: (1) provide the authorized agent written permission to do so; and (2) verify your own identity directly with us. We will not require these steps if we have received proof that you have provided the authorized agent with a power of attorney. We may deny a request from an agent that does not submit proof that they have been authorized by you to act on your behalf. We may also deny a request from an agent that does not meet the requirements for authorized agents under the law.
- Once we have verified your identity (and your authorized agent, as applicable), we will respond to your request as appropriate. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
- Response Timing. We use good faith efforts to respond to a verifiable consumer request within forty-five (45) days after its receipt. If we need more time (up to 90 days), we will inform you of the reason and the extension period needed in writing.
- If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, requests sent electronically through our request form, we will deliver our written response to the verified email associated with the request. If you did not submit the request with us via the online webform, we will deliver our written response by mail or electronically, at your option.
- Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt.
- If we cannot comply with any portion of a request, the response we provide will also explain why, if applicable.
- For data portability requests, we will select a commercially reasonable format to provide your Personal Information that is commonly useable and should allow you to transmit the Personal Information from one entity to another entity without hindrance, but we do not guarantee that all formats are useable in all media.
- Right to Appeal. If we do not act on your privacy request, we will inform you in writing of the reasons for not acting, as well as provide an explanation of any rights you have to appeal the decision.
